del Tribunal Supremo ha declarado en su reciente STS 211\/2021, de 17 de febrero, que el plazo del que dispone el obligado tributario para reinvertir el importe obtenido fruto de la transmisi\u00f3n de su vivienda habitual, cuando la reinversi\u00f3n se materializa en una vivienda que se encuentra\u00a0<strong>en fase de construcci\u00f3n<\/strong>, es el de\u00a0<strong>dos a\u00f1os<\/strong>\u00a0contados desde la transmisi\u00f3n de su vivienda, bastando que en dicho per\u00edodo reinvierta el importe correspondiente y con independencia de que finalmente la habite una vez haya finalizado tal plazo.<\/p><p id=\"wnd_TextBlock_52809_inner_4\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"4\" data-wnd_separable_id=\"wnd_TextBlock_52809\">As\u00ed las cosas, la Sala de lo Contencioso-Administrativo responde a la cuesti\u00f3n aqu\u00ed suscitada en el sentido siguiente:<\/p><p id=\"wnd_TextBlock_52809_inner_5\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"5\" data-wnd_separable_id=\"wnd_TextBlock_52809\">\u00abLa interpretaci\u00f3n de los arts. 38.1 de la LIRPF, y 41 del RIRPF, cuando la reinversi\u00f3n se materializa en una vivienda que se halla en fase de construcci\u00f3n, es la de que el plazo de dos a\u00f1os establecido reglamentariamente para reinvertir es aquel del que dispone el contribuyente, y debe contarse desde la transmisi\u00f3n de su vivienda, bastando a tal efecto -para dar cumplido el requisito- con que en dicho plazo reinvierta el importe correspondiente,\u00a0<strong>sin necesidad<\/strong>\u00a0de que adquiera el dominio de la nueva vivienda, mediante su entrega material, o de que la construcci\u00f3n de \u00e9sta haya ya concluido\u00bb.<\/p><\/div><\/div><div
