De esta manera, la banca deber\u00e1 devolver a sus clientes los gastos de constituci\u00f3n y cancelaci\u00f3n, con efectos retroactivos, salvo que el derecho supletorio nacional disponga otra cosa.<\/p>\n<p id=\"wnd_TextBlock_637404_inner_4\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"4\" data-wnd_separable_id=\"wnd_TextBlock_637404\">La Corte de Luxemburgo recuerda que la nulidad de una cl\u00e1usula por su abusividad debe suponer la anulaci\u00f3n total de la condici\u00f3n desde su origen. El tribunal solo acepta que la restituci\u00f3n sea parcial si la legislaci\u00f3n nacional marcaba que determinados gastos deb\u00eda asumirlos el cliente.<\/p>\n<p id=\"wnd_TextBlock_637404_inner_5\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"5\" data-wnd_separable_id=\"wnd_TextBlock_637404\">Este matiz indica que los consumidores podr\u00edan tener que continuar asumiendo el coste del impuesto de actos jur\u00eddicos documentados, que el Tribunal Supremo adjudic\u00f3 a los clientes tras varias sentencias contradictorias.<\/p>\n<p id=\"wnd_TextBlock_637404_inner_6\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"6\" data-wnd_separable_id=\"wnd_TextBlock_637404\"><strong>No imposici\u00f3n de las costas<\/strong><\/p>\n<p id=\"wnd_TextBlock_637404_inner_7\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"7\" data-wnd_separable_id=\"wnd_TextBlock_637404\">El TJUE resuelve y pone fin a una cuesti\u00f3n pol\u00e9mica y es la no imposici\u00f3n de las costas a las entidades bancarias cuando la Sentencia declara la nulidad de la cl\u00e1usula pero la restituci\u00f3n de las cantidades no coinciden con lo solicitado en la demanda, cosa que ha sucedido con la cl\u00e1usula de gastos desde 2018 debido a la cambiante jurisprudencia del Tribunal Supremo y a la extrema demora de los procedimientos de este tipo que provocan que una demanda presentada conforme a la jurisprudencia vigente al momento de su presentaci\u00f3n se resuelva m\u00e1s de dos a\u00f1os despu\u00e9s, cuando aquella ha cambiado.<\/p>\n<p id=\"wnd_TextBlock_637404_inner_8\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"8\" data-wnd_separable_id=\"wnd_TextBlock_637404\">Y, en\u00a0<strong>relaci\u00f3n a la comisi\u00f3n de apertura,<\/strong>\u00a0cuesti\u00f3n planteada por el Juzgado de Primera Instancia de Palma, como era de esperar, el TJUE considera que el hecho de que la comisi\u00f3n de apertura pueda considerarse parte del precio no la excluye del examen de su abusividad, cuesti\u00f3n que defend\u00eda el Tribunal Supremo y que ha sido censurado (como ya sucediera con el IRPH) por el Tribunal Europeo. Abusividad que debe ser examinada desde la vertiente de la transparencia (que el consumidor estuviera convenientemente informado de su existencia y repercusi\u00f3n econ\u00f3mica) como desde el lado del desequilibrio, al no responder el importe que se paga por el prestatario al coste efectivo del servicio.<\/p>\n<p id=\"wnd_TextBlock_637404_inner_9\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"9\" data-wnd_separable_id=\"wnd_TextBlock_637404\">Por lo tanto, ser\u00e1n los jueces quienes deban examinar si por uno o por otro criterio la cl\u00e1usula ha de declararse nula, sin que sirva de excusa como apuntaba tambi\u00e9n el Tribunal Supremo, que su existencia es suficientemente conocida por los consumidores.<\/p>\n<p id=\"wnd_TextBlock_637404_inner_11\" data-wnd_is_separable=\"1\" data-wnd_separable_index=\"11\" data-wnd_separable_id=\"wnd_TextBlock_637404\"><strong>Qu\u00e9 hacer a partir de ahora?
